Statutory Agent in Arizona Service
Did you know that by law, if you don't have an agent appointed you could miss important notices, lawsuits and potentially lose your home, tenants, deposits or more? There are many reasons to have us in place and at the ready.
Per A.R.S. 33‐1902 Residential rental property must be recorded with the Maricopa County Assessor’s Office (MCAO) AND have an agent designated, the designated Statutory Agent MUST have an Arizona address (NOT A PO BOX) who will accept legal service on behalf of the owner.
AZ Home Renters can provide Arizona Statutory Agent Service for your residential rental property for $75 a year which includes forwarding all notices, service of process and important documents to you in a timely manner and update and keep current addresses on file with the assessor’s office.
You can be your own Arizona Statutory Agent, as long as you have a street address located in the state. However, Statutory Agent Information including your address is Public Record in Arizona. While you do have the option you may not want to have your address listed on public records. Not only is this information searchable by the public, but other websites download the state’s records and republish them on their website. Then things begin to multiply as other “public record websites” take that same information and list it on their website again (and the process repeats itself). Pretty soon your address is listed on various websites and people can easily find it by doing a Google search.
Besides the address privacy issue, there are other potential risks of being your own Arizona Statutory Agent, if a process server is unsuccessful in reaching your Arizona Statutory Agent, a court case can proceed in your absence and you might not even know about it. This can happen if you don’t “continuously maintain” a Statutory Agent on file, or if the MCAO is unsuccessful in reaching your Statutory Agent.
A few reasons a process server might not be able to reach your Arizona Statutory Agent:
You, your friend, or family member is not there during business hours
You/they are on vacation or out of town
You/they moved and you forgot to file a Change of Statutory Agent with the MCAO
